Killexams : Android case: Not possible to negotiate separate agreements with all mobile OEMs: Google tells NCLAT

In the hearing that resumed in the Android matter before NCLAT, Google, on Thursday, submitted that it is not possible for the tech giant to separately negotiate Mobile Application Distribution Agreement (MADA) with each and every counterparty mobile OEM, which runs into thousands in numbers. This is even as the CCI had in its October 20 ruling of last year found that MADA is not negotiated with the OEMs.

The tech giant also asserted that if it negotiates separately with the OEMs, it may potentially face charges of discrimination. 

Thursday was the second day of hearing by NCLAT in the Google appeal in the Android case, where the CCI had imposed ₹1,337 crore penalty on the tech giant and issued 10 non-monetary directions that would require it to change its business model. Google is expected to continue its submissions on Friday.

On Thursday, as regards the CCI’s findings of abuse with respect to MADA, Google submitted that standard form contracts are a standard market practice. 

Under MADA, OEMs are required to pre-install the entire Google Mobile Suite (GMS) covering 11 applications of Google as a bundle, and place these apps on the home screen of the device.

GMS is a collection of Google applications and Application Programme Interface (APIs) that help support functionality across devices. GMS includes wide range of key Google apps such as Google Maps, Gmail, YouTube etc.

CCI had found three issues with respect to MADA. First, if an OEM wants any of Google’s apps under GMS, it has to take it with the other 9-10 apps under the suite. Secondly, these apps have to be placed in a particular manner — Play Store icon, Search widget on, a folder containing other GMS apps on the Home Screen. Thirdly, these apps cannot be uninstalled but can be disabled. 

Google in its submissions on Thursday asserted that MADA is non exclusive, voluntary and gives liberty to the OEMs to pick and choose on which devices it wants GMS apps.

Pre-installed apps

On the issue of pre-installed Apps, Google argued that pre installation of Apps is inherently necessary for success of Android operating system. To ensure this success, Google makes sure that a smartphone comes with a “bundle of quality apps” when purchased, added Senior Counsel Arun Kathpalia representing Google before NCLAT.

As a result of this, the phone is functional when it is purchased, it was submitted. Google relied on user survey data to corroborate its submission.

Earlier, on Wednesday, the first day of NCLAT hearing in the Android case, Google alleged ‘confirmation bias’ against the DG (investigating wing of CCI) in mechanically following the European Commission ruling passed against the tech giant in a similar matter, in 2018.

During the hearing before the NCLAT Principal Bench Justice Ashok Bhushan and Alok Srivastava, Google had also argued that CCI ruling did not show ‘effects’ of its alleged anticompetitive practices in the market. It was also contended that CCI ordered investigation on the basis of complaints filed by its Research Associates. 

The Principal Bench had also on Wednesday ruled that interveners will be heard after completion of arguments by Google and CCI in the appeals. 

 The three interveners in the case are Epic Games, MapMyIndia and OS Labs. Amit Sibal appeared on behalf of Epic Games and Rajshekhar Rao represented MapMyIndia. 

On the issue of ‘confirmation bias’, Google contended that the DGmechanically followed European Commission’s order in Android case without any independent examination and investigation according to India based evidence.

In 2018, the European Union had slapped record antitrust fine of € 4 billion on Google for throttling competition and reducing consumer choice through the dominance of its mobile Android operating system.

Somehow, Mira Murati can forthrightly discuss the dangers of AI while making you feel like it’s all going to be OK.

Murati is chief technology officer at OpenAI, leading the teams behind DALL-E, which uses AI to create artwork based on prompts, and ChatGPT, the wildly popular AI chatbot that can answer complex questions with eerily humanlike skill.

ChatGPT captured the public imagination upon its release in late November. While some schools are banning it, Microsoft announced a $10 billion investment in the company and Google issued a “code red,” fretting that the technology could disrupt its search business. “As with other revolutions that we’ve gone through, there will be new jobs and some jobs will be lost…” Murati told Trevor Noah last fall of the impact of AI, “but I’m optimistic.”

For most of January, ChatGPT surpassed Bitcoin among popular search terms, according to Google Trends. All the attention has meant the privately held San Francisco–based startup—with 375 employees and little in the way of revenue—now has a valuation of roughly $30 billion. Murati spoke to TIME about ChatGPT’s biggest weakness, the software’s untapped potential, and why it’s time to move toward regulating AI.

First, I want to congratulate you and your team on the recent news that ChatGPT scored a passing grade on a U.S. medical-licensing exam, a Wharton Business School MBA exam, and four major university law-school exams. Does it feel like you have a brilliant child?

We weren’t anticipating this level of excitement from putting our child in the world. We, in fact, even had some trepidation about putting it out there. I’m curious to see the areas where it’ll start generating utility for people and not just novelty and pure curiosity.

I asked ChatGPT for a good question to ask you. Here’s what it said: “What are some of the limitations or challenges you have encountered while working with ChatGPT and how have you overcome them?”

That is a good question. ChatGPT is essentially a large conversational model—a big neural net that’s been trained to predict the next word—and the challenges with it are similar challenges we see with the base large language models: it may make up facts.

In a very confident way too!

Yes. This is actually a core challenge. We picked dialogue specifically because dialogue is a way to interact with a model and provide it feedback. If we think that the answer of the model is incorrect, we can say, “Are you sure? I think actually…” And then the model has an opportunity to go back and forth with you, similar to how we would converse with another human.

Truly groundbreaking technologies solve a problem. What problem is ChatGPT solving?

Right now, it’s in the research review stage, so I don’t want to speak with high confidence on what problems it is solving. But I think that we can see that it has the potential to really revolutionize the way we learn. People are in classrooms of, say, 30 people. Everyone has different backgrounds, ways of learning, and everyone is getting basically the same curriculum. With tools like ChatGPT, you can endlessly converse with a model to understand a concept in a way that is catered to your level of understanding. It has immense potential to help us with personalized education.

But some schools are banning ChatGPT. Does this surprise you?

When we’re developing these technologies, we’re really pushing toward general intelligence, general capabilities with high reliability—and doing so safely. But when you open it up to as many people as possible with different backgrounds and domain expertise, you’ll definitely get surprised by the kinds of things that they do with the technology, both on the positive front and on the negative front.

A growing number of leaders in the field are warning of the dangers of AI. Do you have any misgivings about the technology?

This is a unique moment in time where we do have agency in how it shapes society. And it goes both ways: the technology shapes us and we shape it. There are a lot of hard problems to figure out. How do you get the model to do the thing that you want it to do, and how you make sure it’s aligned with human intention and ultimately in service of humanity? There are also a ton of questions around societal impact, and there are a lot of ethical and philosophical questions that we need to consider. And it’s important that we bring in different voices, like philosophers, social scientists, artists, and people from the humanities.

What’s the key ethical or philosophical question that we still need to figure out?

[AI] can be misused, or it can be used by bad actors. So, then there are questions about how you govern the use of this technology globally. How do you govern the use of AI in a way that’s aligned with human values?

Do you think these questions should be left to companies like yours, or should governments get involved in creating regulations?

It’s important for OpenAI and companies like ours to bring this into the public consciousness in a way that’s controlled and responsible. But we’re a small group of people and we need a ton more input in this system and a lot more input that goes beyond the technologies-—definitely regulators and governments and everyone else.

There’s always a fear that government involvement can slow innovation. You don’t think it’s too early for policymakers and regulators to get involved?

It’s not too early. It’s very important for everyone to start getting involved, given the impact these technologies are going to have.

Mira, can you provide me one song or album, one book, and one movie that gives us some insight into who you are and what inspires you?

  • Song: Paranoid Android by Radiohead The song is layered and touches on themes related to society on technology. Not most uplifting but beautiful and thought provoking.

White people can finally relax.

Unlike noted antisemite and acclaimed astrophysicist Marjorie Taylor Greene, I can’t tell an interstellar spacecraft from a Jewish space laser. But when President Joe Biden assured the country that the alien spaceships/spy balloons thangs hovering over Alaska, Canada and Lake Huron were not part of an alien invasion, most people took him at his word.

“We don’t yet know exactly what these three objects were,” Biden said on Thursday. “But nothing — nothing right now suggests they were related to China’s spy balloon program or that they were surveillance vehicles from other — any other country.” People who think “Big Bang Theory” is actually funny breathed a sigh of relief when they found out that China wasn’t spying on us or that E.T. wasn’t coming to pick up his cousin Ted Cruz. But Biden’s next sentence struck fear in the heart of people of rhythmic descent: 

“The intelligence community’s current assessment is that these three objects were most likely balloons tied to private companies, recreation or research institutions studying weather or conducting other scientific research,” said Biden. “We know that a range of entities, including countries, companies and research organizations operate objects at altitudes for purposes that are not nefarious, including legitimate scientific research.”

That’s when I panicked

People of African descent remember that the transatlantic slave trade began when Portuguese trade wind “researchers” Nuno Tristão and Antao Gonçalves pulled up in 1441 and asked an Amazigh fisherman to “take me to your leader.” The Taino will never forget that Christopher Columbus was conducting “scientific research” in 1492 for “other countries” seeking a path to the West Indies. The people living on Turtle Island recall when British “adventurers” from the Virginia Company of London arrived in 1609 and gentrified the west side of Tsenacommacah

The indigenous occupants of Africa, North America, the Caribbean islands and South America were all colonized by UFOs (unidentified foreign oppressors) with ties to “private companies, recreation, or research institutions studying weather or conducting other scientific research.” 

However, if interstellar beings are planning to colonize the “New World,” they’re gonna need some help. And, despite what you might think, white people are terrible colonizers. Black people, on the other hand, are experts in this field of study. 

We managed to survive the first European settlements in the Caribbean and South America. When white people came to North America by themselves, they disappeared into thin air. Ponce de Leon, the first white man to land in Florida, decided to bring a Black guy along. Ponce died from arrow poisoning, but his Black companion survived. In 1525, the first Spanish settlers abandoned the first European settlement in North America after enslaved Africans ran away. The first English settlers almost starved to death until they realized they could survive on a diet consisting of English settlers. Asking our Caucasian countrymen for colonizing advice is like asking Ron DeSantis to help you learn Black history. Even if they tell you what they know, it’s probably wrong.

COURSE OVERVIEW: Taking over an entire planet is a difficult, time-consuming long-term project. Every colonizer will offer their opinion on how this feat can be accomplished. However, one group of people has experienced every conceivable form of human subjugation and managed to survive. Using that historical knowledge and expertise, this course gives imperial intruders the skills necessary to take over any solar system.

PREREQUISITES: Interplanetary navigation 101, Oppression 250, Intro to White Studies

INSTRUCTOR: Black people

COURSE OBJECTIVE: This course is for future alien overlords who seek executive positions in “a range of entities, including countries, companies, and research organizations operate objects at altitudes for purposes that are not nefarious, including legitimate scientific research.”  

After completing this course, prospective extraterrestrial students will be able to:

  • Claim land
  • Survive the relocation
  • Control the inhabitants
  • Form a government
  • Weaponize their alien privilege
  • Create a system of alien supremacy
  • Suppress rebellion
  • Live happily ever after

Course Outline

Week 1 – “Claiming” techniques: Prior to conquering, pillaging and plundering, students will determine how to “claim” the land and resources as their own. Do you offer beads and pelts? Manifest Destiny? Forced migration? Do you pretend to peacefully coexist and slowly encroach on their territory? All options will be explored. 

Week 2 – Political principles: Building a strong political foundation is an essential part of colonizing a people. After examining the morals, religious and ethical beliefs necessary to building a prosperous society, the class will disregard that junk and write a constitution that benefits the aliens. For example, do we say “all lifeforms are created equally” while counting humans as 3/5ths of people who descended from star trekkers? 

Aliens will understand this as a “compromise.” 

Humans will call it “flight supremacy.”

Week 3 – Basic economics: It is important to construct a hierarchal economic system that will allow the alien race to control resources in perpetuity. The easiest way to achieve this goal is to create a class of free labor based on an arbitrary physical characteristic. I know this seems like an evil thing to do (it is), but if you allude to it in your constitution, you can always claim you didn’t support it while simultaneously providing generational wealth for your future descendants.  

Plus, you can always claim that “slavery existed in every galaxy.”

TERM PAPER: Write a brief letter to your former overlord declaring that all lifeforms are created equal which also allows you to treat some lifeforms unequally.

Week 5 – Social and cultural control: The easiest way to control a population is to get them to adopt a system of beliefs carefully constructed to affirm the values that benefit you most. Teach them an interstellar religion, but slightly alter the doctrine to make them believe that your  invisible sky deity supports slaverySteal their children. Ban them from practicing their religion, speaking their language or learning their history. Steal their children. Steal their art, music and history, water it down, monetize it and pretend you created it. 

Did I mention that you should, steal their children?

How else are you supposed to “civilize them.”

  • MIDTERM PROJECT: Create a slur for your human underlings. You will be judged on its lasting effects. If your subjects start using the word so much that your fellow spacemen start to wonder why they can’t use it, you will receive a 10-point bonus. 

Week 6 – Alien privilege: It is impossible for the ruling alien class to share economic, social and political advantages with every alien. However, once you assign a higher value to life forms with green skin, poor aliens will collaborate in the oppression of the BIPOCs (bipedal indigenous planetary oxygen consumers). Once the conquered earthlings start worshipping an alien god, speaking an alien language and navigating an alien society, it will be harder for them to navigate a society constructed specifically to benefit the class of celestial colonizers. 

A few random earthlings might still slip through the cracks. Don’t worry, this doesn’t mean you failed. In fact, point out the people who succeeded in a system designed to subjugate the human race and say:

“See? There is no such thing as systemic racism.”   

Week 7 – Dealing with resistance: After some time has passed, colonized populations may occasionally band together to fight for human racial equality or celestial rights. In the extreme chance that our overlords are forced to emancipate their earthlings, they will explore new methods to control the emancipated. Strategies include creating laws designed to oppress, enlisting officers to enforce the oppression and qualifying the law enforcement officers to be immune from the law. 

The group project will involve building an entire criminal justice system. Don’t be alarmed, the project will be graded on the system’s “criminal” aspects. If it functions properly…  

There’ll be no justice.

Week 8 – Inequality preservation: To maintain alien rule, students will learn alternative methods of control. We will teach classes how to maintain social inequality by separating earthlings from alien life forms (ALFpartheid). If students struggle to create segregation maps (I suggest using red lines) and underfunded schools, they will still be able to steal resources from HBCUs (Human Body Colleges and Universities) and provide them to pillaging world invaders(PWIs). In rare cases, students may need to form a cosmic interstellar program (COINTELPRO) or introduce humans to a highly addictive substance. This way, the people who don’t have smuggling balloons or interplanetary spaceships can participate in the Star Wars on Drugs.

TERM PAPER 2: Write a 10-page paper convincing your fellow classmates that the civil war was about “space rights.”

Week 9 – Space-Baiting: Because humans are easily influenced, we will teach the class how to put their colony on cruise control by getting their subjects to buy into colonized thinking. The class will also learn how to demonize freedom movements by redefining words and coming up with new terms. Instead of that woke, Marxist, politically correct ideology, they will learn to identify “reverse spacism” and stand for the “Star Strangler’s Banner.” They will refuse to acknowledge that carbon-based lives matter but, because aliens don’t have skeletal systems, students will always claim: 

“I don’t have a “spacist bone in their body.”

Lesson 10 – Spacewashing history: How do we explain all of our past evils?

We don’t! 

Even without the use of our time-space transponders, students will explore Caucasian Race Theory. Founded by the scholar Ron DeSantis, CRT teaches students to manipulate the past to make alien kids feel comfortable. They will be taught that the founding cosmonauts were demigods who definitely treated their humans with humanity. New Yorkers will be grateful for the transgalactic space trade because they will never learn about the lasering of white Wall Street. We will never discuss how all aliens benefitted from colonizing their planet. 

Done correctly, aliens will eventually believe they are generically and culturally superior and will tell earthlings to stop playing the “human race card.” Students will demonize people for engaging in “humanity politics” and “making everything about space.” They will suggest that poor humans pull themselves up by their spaceboot straps and focus on earthling-on-earthling crime. And if anyone asks they will be able to recite the mantra of the space supremacists everywhere:

Make Earth great again. 

FINAL EXAM: Write a 20-page thesis. In the first 10 pages, explain in detail how you plan to apply the lessons you’ve learned in the course. After you have traumatized, oppressed, disenfranchised, stolen, beaten and erased the existence of an entire race…

Explain why you are not a spacist country.

You wear a cuff to measure not only your blood pressure but also the stiffness of your arteries, among other vascular readings, from home. You conduct your own vision tests for eyeglasses without leaving the house. You pee in your own toilet to capture urine samples you share remotely with your doctor.

Telehealth has brought doctors back into the house virtually via smartphone, computer and tablet screens. Now several health tests that used to require a trip to a doctor’s office or lab are also being done from the comfort of home. Others are on the cusp of being approved.

You can buy some tests off the shelf at your local pharmacy. Others may require a prescription from your physician, who can then monitor certain conditions from afar.

Health-related tests of one kind or another aren’t entirely new, of course. Women have been able to take home pregnancy tests for decades. Diabetics can prick their finger with a needle to test glucose levels or wear a continuous glucose monitor. Some people share their DNA through 23andMe to screen for hereditary conditions.

COVID makes home testing routine

Millions have grown accustomed to home diagnostics by sticking a swab up their noses, however unpleasant, to test for COVID-19.

“The pandemic definitely changed a lot of people’s opinions of testing at home,” says virologist Mary Rodgers, principal scientist for diagnostics at Abbott, the North Chicago–based health care company behind the BinaxNOW-branded COVID tests.

Nearly half of adults ages 50 to 80 surveyed in July 2023 as part of the University of Michigan’s National Poll on Healthy Aging have purchased at least one at-home medical test. More than 4 in 5 expressed an interest in using them in the future.

“The people who tend to need these sorts of tests more are probably older people. But I think a lot of this is going to be driven by younger people, [who have] an expectation of convenience probably in a way that we never did,” says David Pride, M.D., professor of pathology and the director of microbiology at UC San Diego.

Your smartphone will play a role

The latest generation of home tests may combine sophisticated sensors and artificial intelligence (AI) analysis, often in sync with a smartphone or smartwatch. These digital health tests cover a wide swath of concerns, as you can see from the following products, many of which were exhibited at the January 2023 CES tech fest in Las Vegas.

• Monitoring urine. Withings has launched U-Scan, which the French company markets as the world’s first at-home, hands-free urine lab. To use it, you urinate onto a pebble-shaped, 3½-inch-diameter rechargeable reader that sits in your toilet bowl.

U-Scan has interchangeable cartridges that can analyze various biomarkers. Among the first are a cartridge to help women track hormonal fluctuations in their cycles, and another that measures nutritional balance around vitamin C, ketones and hydration. Data syncs up via Wi-Fi with a smartphone app. Low-energy radar sensors embedded within the U-Scan reader help it identify your urine as distinct from, say, a family member’s.

U-Scan is slated to go on sale in Europe for €500 (about $535) around midyear but hasn’t yet received regulatory approval from the U.S. Food and Drug Administration.

Healthy.io’s Minuteful Kidney test also uses urine to uncover increased risk for chronic kidney disease in its early stages and avert damage that can lead to a kidney transplant or dialysis. The Tel Aviv–based company received FDA clearance last year for its home test kit, which uses a smartphone app to provide immediate results.

• Identifying respiratory viruses. Opteev Technologies in Baltimore has developed a battery-powered, multiple-use handheld breath analyzer test called ViraWarn that the company says can detect all COVID variants, as well as respiratory syncytial virus (RSV) and influenza, in less than 60 seconds.

You blow into this electronic device twice. A carbon filter captures larger particles in your breath. Virus particles pass through. A flashing red light signifies a positive result, though the test won’t tell you what you have; a green light indicates a negative.

ViraWarn comes with a removable mouthpiece and replaceable sensor cartridges. It is in clinical trials and will require FDA approval.

• Checking arteries. The Pulse monitor from Conneqt in Newport Beach, California, promises to do more than the typical cuff-based blood pressure machine. It can capture a patient’s central pulse pressure, which is used to identify damage to the brain, heart and kidneys. Among other features, it can also measure augmentation pressure, a marker that indicates how stiff a person’s arteries are.

The Mentor Police Department is looking for five new officers to join their ranks on a full-time basis in 2023.

Candidates who are interested are required to complete and application as well as take the "National Testing Network's Law Enforcement Frontline National Exam". The Mentor Police Department specified that only test scores from exams taken between March 13, 2023 and March 13, 2023 will be accepted.

In the press release, the police department released this statement in relation to the open positions:

"Most believe that law enforcement should be held to a high standard and the Mentor Police Department agrees. Which is why they are seeking the best candidates in the region to join their team. All interested candidates are strongly encouraged to apply. If you haven’t attended the police academy, that’s ok. Mentor PD is willing to pay your tuition. 

The department offers competitive pay, as well as medical, dental and vision benefits, retirement plan, and deferred comp plan.

The Mentor Police Department wants those who share their passion for public safety and exhibit the integrity and professionalism that our community demands and deserves."
